Apple sued for iPad trademark breach in China

How would you react when I say, iPad isn’t an Apple’s product. Yes, this is the case in China where Apple is sued by a Hong Kong based technology firm called Proview Technologies who owns the trademark ‘iPad’ in some cities of China and Hong Kong.

‘iPad’ was registered way back in 2000 by Proview Technologies and they had been using the trademark in many products including desktop monitors. Apple, on the other hand successfully registered the iPad trademark all over the world but when they applied for the same in China they were denied as it was already registered by Proview Technologies.

China is the second biggest market of Apple’s product and iPad is selling in bunches. But the latest development might be a big roadblock in the success story of Apple in China.

It been said that, negotiations between Apple and Proview Technologies is on since 2006. Proview was ready for the transfer but when the company got aware of the fact that it is dealing with Apple, the IT giant, cash rich company it asked for $10 million for transfer that Apple refused. Apple went to court and lost, with jury stating that its the responsibility of a company to obtain rights of trademark before landing its product in the market.

Now Apple is left with only 2 choices, either to pay the asked amount to Proview Technologies and transfer the trademark, or rename the product and then launch ‘iPad’ in the Chinese market.
